Rhodes, 393 U.S. 23, 29 (1968), the State of Ohio contended that Art. II, s. 1 gave it absolute power to "put any burdens it pleases on the selection of electors . . . ." The court, at 34, said the Ohio law violated the Equal Protection Clause (14th Amendment). It stated, at 29, that powers granted by the Constitution to Congress or the states are "always subject to the limitation that they may not be exercised in a way that violates other specific provisions of the Constitution." It specifically held that the power to select presidential electors could not "be expressed in such a way as to violate express constitutional commands that specifically bar States from passing certain kinds of laws."
